Terms of Service

These Terms of Service ("Terms") govern your use of the Timingle mobile application and related web services (the "Service"), provided by CNHOLIC ("we", "us", or "the Company"), and form a binding legal agreement between you and us.

The statutes named below reflect commonly held understanding; we have not checked section numbers or wording against the official sources. ADR 011 expressly prohibits citing country-specific legal requirements without fresh research, and that research has not been done for this version.

This English version is prepared on the basis of United States law. Users in the United Kingdom or the European Union are subject to UK GDPR / GDPR, which require additional disclosures not covered here — a separate version is required.

ADR 011 named the target market only as "English-speaking countries" and never narrowed it further. Which countries that phrase covers is still an open question. We chose the United States as the basis for this draft because it is the largest English-language market, not because a decision was recorded. Until that decision is made and separate UK/EU versions exist, this document must not be offered to users in the UK or the EU.

Unlike Korea, the United States regulates personal data mainly through sector-specific federal laws and individual state laws (California, Virginia, Colorado, Connecticut, Texas, Utah and a growing list of others). The obligations that apply to us therefore depend on where each user lives, and they change frequently. See the Privacy Policy for how this affects user rights.

Note on the placeholders removed on 2026-09-25

Korean e-commerce law requires them only of mail-order (paid) sellers, so a free service has no duty to display them, and we keep the owner's personal details to the minimum. All five return as mandatory the moment paid services begin. There is no United States equivalent, and we have not confirmed what a US-facing seller disclosure would need to contain instead.

Article 1. Purpose

These Terms govern the relationship between 씨엔홀릭 ("we", "us", or "the Company") and you, setting out the rights, obligations and responsibilities that apply when you use timingle, which we provide as a mobile app and in a web browser ("the Service").

Article 2. Definitions

  1. Service — the timingle application and all of its features, which let you create plans to meet other people and communicate around those plans.
  2. User — a person who agrees to these Terms and uses the Service.
  3. Account — the credential that identifies you within the Service.
  4. Social sign-in — signing in to the Service by verifying your identity through a Google or Apple account.
  5. Plan — a meeting you create in the Service, including details such as its title, place and time.
  6. Content — anything you enter or upload to the Service, including plan titles, places, the messages you exchange inside a plan (chat messages), the pictures you exchange inside a plan and your profile picture, and your display name. 🔺 2026-08-26 — spec 017A added pictures to this list of examples. The definition itself ("anything you enter or upload") covered pictures from the start; only the examples did not name them.

Article 3. Posting and Changing These Terms

  1. We publish these Terms where you can read them at any time, either inside the Service or at a web address we tell you about.
  2. We may amend these Terms so long as the amendment does not breach applicable law.
  3. When we amend these Terms we will set an effective date and announce the change, inside the Service or at that web address, at least 7 days before it takes effect. If the amendment is unfavourable to you, we will announce it at least 30 days before it takes effect.
  4. If you continue to use the Service after an amendment takes effect, you are treated as having accepted it. However, where a required consent item changes, the Service may ask you to consent again, and your access may be limited if you decline.
  5. If you do not accept an amendment, you may terminate your agreement with us. Article 8 explains how.

Article 4. Formation of the Agreement

  1. The agreement is formed when a person who wants to use the Service accepts these Terms and the Privacy Policy, and we accept their application.
  2. Registration is only possible through social sign-in. We do not issue separate usernames or passwords.
  3. We may refuse an application, or terminate the agreement later, in any of the following cases:
    1. The applicant is under 14 (Article 5);
    2. The applicant used someone else's social account without permission;
    3. The applicant was previously suspended for breaching these Terms;
    4. It is clear that the applicant will interfere with the normal operation of the Service;
    5. Any other breach of applicable law.

Article 5. Minimum Age

  1. You may not register for the Service if you are under 14.
  2. We check your age using the date of birth you enter yourself during registration. We do not independently verify that date; we rely on what you tell us.
  3. If we find that you registered with a date of birth that is not true, we may suspend your access or terminate the agreement.
  4. To prevent people from evading paragraph 1 by editing their age repeatedly, we limit how many times a date of birth can be changed from the same device within 24 hours.

⚠️ How this relates to COPPA — read before publishing

The Children's Online Privacy Protection Act (COPPA) is the principal United States federal statute covering children's data, and it applies to children under 13. Our floor of 14 therefore sits above that line: on its face, no one COPPA protects can register.

That does not by itself make us compliant. COPPA turns on whether a service is directed to children and on what the operator actually knows, not only on a stated age limit — and we accept a self-declared date of birth that we never verify. ADR 015 removed children from the first release and relies on this age gate as the defence, but that decision was made without legal advice. SPEC-PLAN.md item C11 records the open question as: whether a self-declared age gate is a sufficient defence in each jurisdiction, and what evidence is needed to show that we do not target children.

We have not re-verified COPPA's current requirements. ADR 005 records that a 2025 amendment took full effect on 2026-04-22 and expanded what counts as personal information. Confirm the current rule before publishing.

Some US state laws set higher thresholds for minors than 13, and several impose extra duties for users under 16 or 18. We have not surveyed them.

Article 6. Your Account and Your Responsibility for It

  1. Your Account is for your use only. You may not lend or transfer it to anyone else.
  2. You are responsible for keeping your own social account secure. We are not liable for loss caused by someone else gaining control of your social account, except where the loss is caused by our own intent or negligence.
  3. You may sign in from more than one device. We track sign-in status separately for each device.
  4. If you learn that your Account has been compromised, tell us immediately at help@timingle.app and we will advise you on what to do.

Article 7. Your Content

  1. You keep the rights in the Content you enter. We do not claim ownership of it.
  2. We store and display your Content only as far as we need to in order to run the Service. That includes showing it to the other people taking part in the same plan.
  3. We do not use your Content in advertising or promotion.
  4. You are responsible for what your Content says. You must not enter anything that infringes someone else's rights or breaks the law.
  5. We may hide or remove Content that falls into any of the categories below, and we will tell you what we removed and why:
    1. Content that defames someone or infringes their rights, including privacy, likeness and copyright;
    2. Content that is unlawful or connected to a crime, including non-consensual intimate imagery and child sexual abuse material;
    3. Advertising or spam;
    4. Anything else that breaches applicable law.
  6. A plan is a shared record created by several people. If one User terminates their agreement while other participants remain in a plan, we keep the plan itself so that the remaining participants do not lose their record, and we make the departing User unidentifiable within it.
  7. Reporting infringing Content and temporary measures. Anyone whose rights — such as privacy or reputation — are infringed by Content may ask us, with supporting facts, at help@timingle.app to remove it or to post a rebuttal. On receiving such a request we will without delay remove the Content or take another appropriate measure, and inform both the requester and the person who posted it. Where infringement is hard to judge or a dispute between the parties is likely, we may temporarily block access to the Content for up to 30 days (Article 44-2 of Korea's Network Act). Requests to stop reproduction or transmission on copyright grounds are received through the same channel (Article 103 of Korea's Copyright Act). Messages and people within the same plan can also be reported through the in-app report, and we handle such reports by the same standard. The person who reported is not revealed to the person who posted.
  8. Reporting non-consensual intimate imagery. If you find such material being circulated through the Service, you may report it at help@timingle.app or through the in-app report; once we clearly recognise it, we will remove it or block access to it without delay (Article 22-5 of Korea's Telecommunications Business Act).

⚠️ Draft-only note (delete before publishing) — paragraph 6 is actually enforced. 🔺 2026-08-11 · Spec 025 · 🔺 2026-08-15 · Spec 007 · Spec 027 Paragraph 6 is now enforced. When an account is erased, each plan it created is checked for other remaining participants; if any remain the plan is kept and only the creator's identity is cleared, and if none remain the plan is erased with the account. The two steps run in a single transaction, so no half-deleted state is left behind. Spec 027 built that code. ⚠️ Two paragraphs of the old note were deleted here on 2026-08-15 — what they said and why they went: ① one said, in effect, that the situation this paragraph addresses could not arise yet; spec 007 (plan participant roster), shipped the same day, let a plan hold several people and made that untrue. ② the other warned that the database design physically prevented the anonymisation; spec 027 changed that design in migration 011 (the rule that erased an account's plans along with it was replaced by one that clears the creator's slot). The breach of this paragraph and of Article 6 of the privacy policy is resolved. Neither sentence is one to restore — doing so would mean reverting both the participant roster and migration 011. ⚠️ Anonymisation still happens only when the deletion command is run with its explicit "actually delete" flag — if nobody runs it, terminated accounts remain and nothing is anonymised (the safeguard spec 025 established is unchanged).

Article 8. Ending the Agreement

  1. You may end your agreement with us at any time.
  2. You can close your account yourself, in the app's Settings screen. Choosing Delete account there tells you what is erased and what remains, and asks you to type a confirmation phrase exactly before the closure is carried out. If you cannot sign in and therefore cannot reach that screen, please email help@timingle.app. We will process it once we have confirmed your request.
  3. What happens to your personal information after termination, and how long we keep it, is governed by the Privacy Policy.
  4. We may terminate the agreement if you breach these Terms. Before we do, we will tell you why and give you a chance to respond — except in urgent cases, where we may act first and explain afterwards.

Article 9. Prohibited Conduct and Restrictions on Use

  1. You must not:
    1. Impersonate another person or misuse their account or personal information;
    2. Enter a false date of birth to get around the minimum age;
    3. Harass, threaten, or incite hatred against other Users;
    4. Use the Service to send advertising or spam;
    5. Access our servers or software improperly, or interfere with the normal operation of the Service;
    6. Access the Service or harvest data from it by automated means without our permission;
    7. Reverse engineer the Service, or copy or distribute it without authorisation;
    8. Do anything else that breaks the law or is contrary to public order.
  2. If you breach paragraph 1, we may act in proportion to the breach, normally in this order: warning → temporary suspension → permanent suspension and termination. We may suspend immediately where the breach is serious or urgent.
  3. When we restrict your use of the Service we will tell you why and for how long.
  4. If you disagree with a restriction you may object by emailing help@timingle.app. If your objection is well founded, we will lift the restriction.

Article 10. Paid Services

⚠️ This article is written for the future. The Service has no paid features today.

  1. We may offer paid services in future. If we do, we will publish what they include, what they cost and how to pay for them inside the Service beforehand.
  2. Payment for any paid service is handled by the Apple App Store or Google Play. We do not process payments ourselves, and we neither receive nor store your card number, bank account number or other payment credentials.
  3. Cancellations and refunds follow the refund policies of the Apple App Store or Google Play. We will direct refund requests to the relevant store, and we will refund you directly where the law requires us to.
  4. Subscriptions renew automatically unless you cancel. You can cancel automatic renewal in the subscription settings of the relevant store.
  5. We may change or discontinue a paid service. If we do, we will give at least 30 days' notice and, for anyone who has already paid, refund the unused portion or provide an equivalent alternative.

Article 11. Purchases by Minors

⚠️ This article is written for the future. It must be re-examined when payment work begins.

  1. Because our minimum age is 14, Users between 14 and the age of majority where they live may be able to make purchases.
  2. The rules on whether a minor's purchase can be voided differ from state to state in the United States, and we have not surveyed them. Where the law gives a minor or their parent or guardian the right to cancel a purchase, we will honour it.
  3. We encourage families to use the Family Sharing and purchase approval features offered by Apple and Google. How those features are configured and whether they work is within each store's control, not ours.
  4. Send cancellation requests to help@timingle.app. We will handle them through the relevant store's process.

Article 12. Availability, Changes and Interruptions

  1. We aim to make the Service available 24 hours a day, every day.
  2. We may suspend all or part of the Service:
    1. For maintenance, repair or replacement of systems;
    2. Because of communications failures, power cuts, natural disasters or other causes outside our control;
    3. Because an external service the Service depends on — a social sign-in provider, a cloud provider and so on — has failed.
  3. We will give at least 24 hours' notice of planned interruptions. We will announce emergency interruptions afterwards.
  4. We may add or change features to improve the Service. If we change an important feature to your disadvantage, or shut the Service down entirely, we will give at least 30 days' notice.

Article 13. Privacy

  1. We protect your personal information in accordance with applicable law.
  2. What personal information we collect, why we collect it and how long we keep it are set out separately in the Privacy Policy, which we publish alongside these Terms.

Article 14. Disclaimers and Limitation of Liability

⚠️ Not reviewed by a lawyer. US consumer contracts usually require limitations of liability to be presented conspicuously, and some states restrict how far they can go. The scope and formatting of this article must be confirmed before publishing.

  1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
  2. We are not responsible for the following, except where we have acted intentionally or with gross negligence:
    1. Failure to provide the Service because of natural disasters, war, power cuts, loss of communications or other causes outside our control;
    2. Loss caused by your failure to keep your own social account secure;
    3. Loss caused by inaccurate information you entered into the Service;
    4. Disputes and loss arising because Users did not keep a plan they made with each other;
    5. Loss arising from dealings you have outside the Service with someone you met through it.
  3. The Service is only a tool that helps people arrange to meet. We do not guarantee that any plan will happen or be honoured.
  4. We do not warrant that Content posted by Users is accurate or reliable.
  5. Nothing in this article excludes any liability that applicable law does not allow us to exclude. Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this article may not apply to you.

Article 15. Disputes and Governing Law

⚠️ Unresolved — decide before publishing

This article currently names the law of the Republic of Korea, because that is where the operator is based. It has not been assessed against United States law.

Two things are missing and both are decisions, not drafting:

  1. Whether Korean law and Korean courts can properly be imposed on a US consumer. US courts do not always enforce foreign forum clauses in consumer contracts, and several states restrict them.
  2. Whether to include an arbitration agreement and a class action waiver. Most US-facing consumer terms do. That is a deliberate commercial and legal choice with real consequences for users, and no one has made it. We have not drafted one, because inventing a dispute mechanism the operator has not chosen would be worse than leaving the gap visible.

Do not publish this version until a US lawyer has settled both points.

  1. If a dispute arises about the Service, we and you will each try in good faith to resolve it by discussion.
  2. You may send complaints or comments about the Service to help@timingle.app, and we will deal with them promptly. If we cannot resolve something immediately, we will tell you why and when we expect to.
  3. These Terms and your use of the Service are governed by the law of the Republic of Korea (⚠️ see the warning above).
  4. Any dispute not resolved by discussion will be brought before the courts with jurisdiction under Korean civil procedure law (⚠️ see the warning above).
  5. Nothing in this article limits any right you have under the consumer protection law of the place where you live.

California residents

Under California Civil Code section 1789.3, California residents may report complaints about the Service to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. ⚠️ We have not re-verified the current contact details for that unit, so they are deliberately omitted here. Confirm and add them before publishing.

Supplementary Provisions

These Terms take effect on 2026-11-01.
